The petitioner apprehends his arrest in a case registered for the offences punishable Sections 147, 148, 149, 341, 323, 307, 354B, 379, 504, 506 and 302 of the Indian Penal Code.

Petitioner is said to have assaulted the wife of the informant with an iron rod as a result of which she sustained injury on head.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to land dispute. He submits that there is general and omnibus allegation levelled against the petitioner. He submits that there is no allegation against the petitioner of assaulting the deceased. There is specific allegation of assaulting the deceased

Patna High Court CR. MISC. No.5530 of 2023(2) dt.10-04-2023 2/2 is on Madan Prasad. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application. However, learned APP for the State and learned counsel for the informant oppose the prayer for bail and submit that from the postmortem report, it is clear that the deceased received several injuries. He submits that the petitioner is also involved in the present case.

Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Dhanarua P.S. Case No. 446 of 2022. (Anjani Kumar Sharan, J) devendra/- U T
