====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The Petitioner seeks regular bail in connection with G.O.Case No. 734 of 2018 arising out of Darbhnaga Sadar P.S.Case No. 333 of 2018, registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Allegation as per F.I.R. against the petitioner is of recovery of seven liters of royal stag from the possession of the petitioner and accordingly, a seizure list has been prepared and the petitioner is an accused in one more case. Submission of the learned counsel for the petitioner is that the petitioner is named in the F.I.R.however, his name surfaced on the confessional statement of the apprehended
Patna High Court CR. MISC. No.5471 of 2019(3) dt.13-03-2019 2/2 person, Govind Kumar and the petitioner is ready to abide all the terms and conditions, imposed upon him.
Heard learned A.P.P., who opposes the prayer for bail on the ground that the girl is minor.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, accordingly, prayer of anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrender before the court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.
With the aforesaid observation, the instant petition is disposed of.
