The petitioner is apprehending his arrest in connection with Barharia P.S. Case No.299 of 2018 registered for offences punishable under Sections 447, 341, 323, 307, 379, 504/34 of the Indian Penal Code.

Allegation against the petitioner is of assault of Tangi on the head of the Majiz Ali.

Submission of learned counsel for the petitioner is that no injury is caused and the further submission of the petitioner is that the allegation is false and concocted. Heard learned A.P.P. as well as learned counsel for the informant.

From perusal of the injury report which has been annexed by the petitioner, it appears that large fracture involving

Patna High Court Cr.Misc. No.2366 of 2019(3) dt.01-02-2019 2/2 parietal and temporal bone with marked adjacent scalp hematoma was found on head and there is allegation against this petitioner by Tangi on head.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner rather the petitioner who surrender before the Court below and pray for regular bail which shall be considered by the Court below on its own merit without being prejudiced the order of this Court.
