====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Gaya Rail P.S. Case No. 139 of 2018, instituted for the offence under Section(s) 379 and 414 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner has clean antecedent. He has been arrested by the police merely on suspicion.

It is alleged in the written report that informant was travelling by train No. 12307Up Howrah-Jodhpur Express and when train stopped at Gaya Railway Station, one stranger tried to come down from the train with trolley bag of the informant. It is further alleged that aforesaid person was caught hold by RPF person at the gate of train. He disclosed his name as

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion.

Petitioner is in custody since 25.5.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Railway Magistrate, Railway Court, Gaya, in connection with Gaya Rail P.S.
