JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-06-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the opposite parties. Petitioner is apprehending arrest in connection with Complaint Case No. 198c of 2019 for the offence under sections 417, 420 of the Indian Penal Code.

On 2.3.2020 the Court while granting protection to the petitioner made it clear that if the petitioner would be reluctant to return the money, the Court may refuse to grant bail to the petitioner.

Learned counsel for the petitioner submits that some time may be granted to the petitioner so that the petitioner may return the money.

No.5515 of 2020(3) dt.30-06-2020 2/2 Considering the facts situation, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of two months from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Munger, in connection with Complaint Case No. 198c of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner has to return the money to the complainant within a period of one month.
