JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code and Section 27 of the Arms Act. Petitioner no. 1 is said to have assaulted the informant whereas petitioners no. 2 and 3 as well as one coaccused, Arun Yadav assaulted the informant's brother. The photostat copy of injury report of informant goes to show that the informant sustained altogether seven injuries but except one injury that is, too, on right forehand, all the injuries of informant were found simple in nature. So far as injury of informant's brother is
Patna High Court Cr.Misc. No.20349 of 2016 (2) dt.09-05-2016 2/2 concerned, he, too, sustained altogether seven injuries and opinion regarding three injuries were kept reserved.
Submission on behalf of the petitioners is that the alleged occurrence is said to have taken place on 26.03.2015 but up till now, opinion regarding the aforesaid injuries had not been produced before the court below though charge sheet has already been submitted.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No. 51 of 2015.
