Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 20,22,23,24,27,27(A),29 of the N.D.P.S. Act. 460 Gms of Charas like substance was allegedly recovered from the motorcycle of the petitioner. The petitioner and co-accused were apprehended at the spot.

Submission is that recovery is less than commercial quantity. Petitioner is in custody since 10.08.2020. Investigation of the case is already complete. Petitioner has got no criminal antecedent under N.D.P.S. Act.

Considering the facts of this case, let the petitioner, above named, be released on bail after framing of the charges so that the trial may not hamper on furnishing bail bond of

Patna High Court CR. MISC. No.16045 of 2021(3) dt.29-09-2021 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Desari Police Station Case No.203 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
