The PDS licence of the petitioner appears to have been suspended on his having been made accused in a criminal case.

However, no final order has been passed by the Licencing authority and the licence of the petitioner remains under animated suspension. Till date, the petitioner has not even been served with a show-cause notice.

Patna High Court CWJC No.1703 of 2022 dt.25-02-2022 2/2 Under the aforesaid circumstances, we direct the Licencing authority to serve a notice upon the petitioner for further action in that regard viz. cancellation of his licence and on receipt of his reply, pass a final order within the mandated period provided under Rule 28 of the Bihar Targeted P.D.S. (Control) Order, 2016.

Needless to state that the petitioner shall be given all opportunities to represent his case and the order passed by the Licencing authority shall be a reasoned one, which shall be communicated to the petitioner without any delay. With the aforesaid direction/observation, the writ petition stands disposed off.
