The petitioner is languishing in custody since 23.12.2014 in a case registered for the offences punishable under Sections 395 and 397 of the I.P.C.
The prosecution case is that when the informant was in his jewellery shop, some unknown persons came there and on the point of fire arms and bomb, looted the gold ornaments and mobile and after looting they fled away after bombing in the market.
Learned counsel for the petitioner submits that he is not named in the F.I.R. and nothing has been recovered from the possession of the petitioner. The name of the petitioner figured in
Patna High Court Cr.Misc. No.29188 of 2015 (2) dt.05-08-2015 2/2 the confessional statement of co-accused Uttam Kumar Singh and thereafter Md. Mobarak @ Md. Mubarak.
It has been further stated that when the petitioner was apprehended, he is said to have confessed his guilt but there is no tangible evidence to show the involvement of the petitioner nor the petitioner has been put on Test Identification Parade. A Co-ordinate Bench of this Court has granted bail to one of the co-accused Md. Mobarak @ Md. Mubarak passed in Cr. Misc. No. 9106 of 2015 dated 12.03.2015.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Town P. S. Case no. 427/2013. (Nilu Agrawal, J) Sudha/- U T
