The petitioner is languishing in custody for the offence punishable under Sections 272/273/467/468/471/120B of the Indian Penal Code and Sections 30(a), 36 and 41(i) of the Bihar Prohibition and Excise Act.

Petitioner is driver of the truck from which huge quantity of liquor was recovered. Petitioner has stated on oath that he has got no criminal antecedent. Petitioner is in custody since 19.11.2020. Investigation of the case is already complete. Considering the period already undergone by the petitioner and the fact that this is the first allegation against the petitioner under Bihar Prohibition and Excise Act, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the

Patna High Court CR. MISC. No.15983 of 2021(3) dt.22-09-2021 2/2 like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gaighat P.S. Case No. 377 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
