2. The petitioner apprehends his arrest for the offences alleged under Sections 8 and 10 of the Bihar Conduct of Examination Act, registered in connection with Nagar P.S. Case No. 276 of 2013.

3. It is submitted that the petitioner has been falsely implicated in connection with impersonating his wife Kusum Kumari at the Examination Centre and nothing has been recovered from his possession, such as admit card etc. The petitioner is on police bail since 19.06.2013.

4. In that view of the matter and having regard to the decision of the Hon'ble Division Bench in the case of Bishundeo Sahu vs. The State of Bihar and Others, 2011(1) PLJR 731, the present anticipatory bail petition held to be not maintainable.

5. Let the petitioner surrender before the Court of learned Chief Judicial Magistrate, Aurangbad in connection with Nagar P.S. Case No. 276 of 2013.
