JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 396, 412 of the Indian Penal Code.
Petitioner is not named in the first information report but it appears from perusal of the impugned order that name of petitioner came in confessional statement of co-accused. So far as recovery of looted articles is concerned, learned counsel for the petitioner submits that the aforesaid recovery has not been made either from conscious possession of the petitioner or on the basis of his confessional statement. Petitioner does not have any criminal antecedent and having more or less similar allegation,
Patna High Court Cr.Misc. No.20518 of 2016 (2) dt.19-05-2016 2/2 some co-accused have already been granted privilege of bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Chhapra Muffasil P.S. Case No. 225 of 2015.
