JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioners and the learned APP for the State Sri Ashok Kumar.

Patna High Court CR. MISC. No.25109 of 2021(2) dt.08-09-2021 2/2 The present petition has been filed seeking restoration of a petition bearing Cr. Misc. no. 78884 of 2019, which has stood dismissed on account of non-compliance of the peremptory order dated 03.12.2019.

The learned counsel for the petitioners, in presence of the learned APP for the State, Sri Ashok Kumar, Advocate submits that on account of the prevailing situation due to Covid 19 pandemic, the defects could not be removed but the same shall be removed within a period of four weeks from today, if not already removed.

Having regard to the facts and circumstances of the case and considering the averments made in the present petition, I deem it fit and proper to restore the aforesaid petition bearing Cr. Misc. no. 78884 of 2019, to its original file, subject to removal of the defects, if any, within a period of four weeks from today by resorting to physical mode.
