2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352 and 3(5) of the BNS, 2023.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 8 is a woman and informant alleges that while he was getting his land measured by a Government Amin, when Mahendra, Dharmendra, Dinesh, Mahesh, Parmanand, Nagendra and Shailendra along with Sanju Kumari came variously armed and started assaulting him, further when his father came to save him, he was also assaulted by the accused persons causing fracture of right leg and left hand, thereafter they were taken for hospital for treatment.

4. Learned counsel appearing on behalf of petitioners submits that petitioners have been falsely implicated in the instant case on account of dispute relating to land being agnates. It is next submitted that from perusal of allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioners and the entire family members have been implicated. It is also submitted that injury suffered by the injured is simple in nature, except one of Gajadhar Yadav, but then it is reiterated and submitted that allegation of assault is not specific. It is next submitted that from side of petitioners Naubatpur P.S. Case No. 503 of 2024 has been instituted against the side of informant. It is also

5. Learned Additional Public Prosecutor for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial Court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of the learned trial Court, where the case is pending / successor Court, in connection with Naubatpur P.S. Case No. 504 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Satyavrat Verma, J) Shahnawaz/- U T
