JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 30.3.2016 in a case registered for the offences punishable under Sections 498A,354,323 and 406 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.
The basic accusation is of torture for non fulfillment of dowry demands. It is alleged that co accused Giridhari Sharma tried to outrage the modesty of the informant. It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant. It is further submitted that the father of the petitioner filed informatory petition no. 11073 of 2015 against the informant and her family
Patna High Court Cr.Misc. No.20773 of 2016 (2) dt.10-05-2016 2/2 members. In fact the informant and her sister were married with the petitioner and his brother respectively but subsequently informant's sister Beena Kumari eloped with her lover Md. Nikku leading to registration of Munger Kotwali PS Case No. 209 of 2015 with the accusation under section 366A IPC. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Munger in connection with Munger Kotwali P.S. Case No. 22 of 2016.
