The petitioner seeks bail in Raxaul P.S. Case No.114 of 2019 registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.

Allegation against the petitioner is about recovery of 35 liters of country made liquor loaded on a bicycle and the name of the petitioner was disclosed by a persons, present at the place of occurrence during search and seizure. Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he in custody since 19.12.2019. Further submission is that nothing has been recovered from the conscious possession of the petitioner and he has been made accused on the basis of

Considering nature of allegation, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran at Motihari in connection with Raxaul P.S. Case No.114 of 2019 with condition that the petitioner shall cooperate in the investigation, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner.
