The petitioner seeks bail in Sakra P.S. Case No. 13 of 2015, registered for the offences punishable under Section 366A and other Sections of the Indian Penal Code.

The mother of the victim made allegation that the petitioner and others kidnapped her daughter while she was going to attend the class.

It is submitted that the victim is wife of Avinash Kumar, son of Awadhesh Paswan and Shashikala Devi filed Sakra P.S. Case No. 12/2015 that the uncle of his daughter-in-law and others took her from her house with her child in her lap. The victim made statement under Section 164 of the Cr.P.C. and she disclosed that the petitioner and others including Avinash kidnapped her and kept her in the house of their relatives.

Patna High Court Cr.Misc. No.30722 of 2015 (2) dt.14-08-2015 2/2 Annexure-3 shows that the victim was married to Avinash Kumar, the brother of the petitioner, but against the will of her parents and that is why this case has been lodged.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate (East), Muzaffarpur, in connection with Sakra P.S. Case No. 13/2015.
