The petitioner seeks bail in a case registered for the offences punishable under sections 302, 120-B and other allied Sections of the Indian Penal Code and section 27 of the Arms Act.

Some land dispute was going on in between Ram Baran Singh and Shivjee Singh for which some verbal altercation had taken place. Shivjee Singh, the petitioner, lodged a case in which Awadhesh Singh, deceased, played a role of mediator between Shivjee Singh and Ram Baran Singh. It is alleged that while Awadhesh Singh was returning from the market, Rajesh Singh, Dhiraj Kumar, Brajesh Singh, Yogendra Singh, Naresh Singh, Ranjit Singh and Dhananjay Singh are alleged to have

Patna High Court Cr.Misc. No.29657 of 2015 (2) dt.10-08-2015 made indiscriminate firing causing the death of Awadhesh Singh and one Dhiraj Kumar was also injured. There is no allegation against the petitioner that he played any role in the second incident of firing in which Awadhesh Singh was killed. Considering the facts aforesaid, let the petitioner above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Barh in connection with Salimpur P.S. Case No. 45 of 2015.
