The petitioner seeks regular bail in connection with Durawdha P.S. Case No. 223 of 2018 registered for the offence punishable under Sections 30(a) and 38(6) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of four litres of illicit Mahua liquor from the possession of the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case only on account of the fact that he is accused in four other cases in which he is on bail. It is submitted that the petitioner is in custody since 05.11.2018.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.3084 of 2019(2) dt.23-01-2019 2/2 case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Session Judge-2, Siwan in connection with Darawdha P.S. Case No. 223 of 2018. It is needless to state that in case the petitioner is implicated henceforth in similar type of crime, the present privilege of bail shall stand cancelled forthwith. (Mohit Kumar Shah, J) S.Sb/- U T
