JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-07-2019 As prayed for, learned counsel for the petitioner is permitted to make necessary correction in the cause title and at paragraph-4 of this application with regard to the name of the village of the petitioner within course of the day. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Khizarsarai P.S. Case No.47 of 2011 registered under Sections 304(B) and 201/34 of the Indian Penal Code. The accusation is of killing the deceased, the daughter of the informant, by her husband (petitioner) and other in-laws for non fulfillment of the dowry demand and to dispose of her dead body.

Patna High Court CR. MISC. No.6062 of 2019(3) dt.09-07-2019 2/3 Learned counsel for the petitioner submits that, admittedly, the petitioner is the husband of the deceased. In fact, the deceased died in course of treatment and her dead body was disposed of. It has also come in paragraphs-19 and 20 of the case diary that the deceased was admitted at P.M.C.H., Patna, where she died. While the police on investigation submitted the final form but the learned court below differing with the final form submitted by the police took the cognizance of the offence against the petitioner. Further submission is that the petitioner was granted provisional anticipatory bail by a Bench of this Court vide order dated 04.02.2019 but due to illness of his sister, he could not furnish the bail bonds before the court below within the period as granted by a Bench of this Court vide order dated 04.02.2019.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Gaya, in connection with Khizarsarai P.S. Case No.47 of 2011, subject to the conditions laid down under
