The petitioner seeks bail in Spl. Case No. 19/2015 (arising out of Vigilance P.S. Case No. 36/2015), registered for the offences punishable under Sections 7, 13(2) along with 13(1)(d) of Prevention of Corruption Act, 1988.
The petitioner was caught red handed by accepting bribe Rs. 10,000/-.
It is submitted that the charge-sheet has already been submitted and petitioner is in jail since 09.05.2015. On the other hand, learned counsel for the Vigilance vehemently opposed the prayer for bail and submitted that the petitioner refused to grant bail to the informer. Even though the case was not found true under Section 307.
The approaching to the police for grant of bail itself appears
Patna High Court Cr.Misc. No.30733 of 2015 (2) dt.14-08-2015 2/2 that the informer was highly interested.
Considering the facts aforesaid and the fact that the chargesheet has already been submitted, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance 1st, Patna, in connection with Spl. Case No. 19/2015 (arising out of Vigilance P.S. Case No. 36/2015).
