Petitioner is accused in connection with Korha P.S. Case No. 249 of 2015 registered under Sections 304(b)/34 of the I.P.C.
The prosecution case is that the marriage of the daughter of the informant was performed with this petitioner in the year 2013, but after marriage, she was being tortured. On 16.12.2015, the informant came at Sasural of his daughter on hearing about her illness and asked with the petitioner why she is weak and ill. He replied that medicine is being given but she is not regaining her health. Thereafter, informant took his daughter on 18.12.2015 in his house but she became ill and admitted in the
Patna High Court Cr.Misc. No.20706 of 2016 (2) dt.17-05-2016 2/2 hospital and on 20.12.2015, she died in course of treatment. Informant raised suspicion to the fact that due to torture and assault by the husband and in-laws, his daughter became ill and died.
Submission is that the petitioner, who happens to be husband, has falsely been implicated in this case by the informant mere on suspicion. It is also submitted that petitioner is in custody since 24.02.2016.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Katihar in connection with S.T. No. 87 of 2016 arising out of Korha P.S. Case No. 249 of 2015.
