This application has been filed for quashing the order dated 13/11/17 passed in G.R case no- 350/16 arising out of Benipatti P.S Case no- 74/16 whereby and whereunder cognizance has been taken under section- 147, 148, 149,323, 326,387,379,307 and 504 I.P.C by the Additional Chief Judicial Magistrate, Benipatti, Madhubani.
3. Learned counsel for the opposite party No. 2 has submitted that after filing of the case, the discharge application was filed which was not pressed by the accused persons and thereafter the charges were framed and in the trial three
Patna High Court CR. MISC. No.4864 of 2019(3) dt.18-03-2025 2/2 witnesses have been examined.
4. In my opinion, this case has become infructuous though Mr. Shahnawaz Ali, learned counsel for the petitioner has tried his best to argue the case on merit.
