JUSTICE PARTHA SARTHY ORAL ORDER 27-08-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has preferred the instant application for grant of regular in a case registered under sections 302, 364 and other sections of the Indian Penal Code.

As per allegation in the F.I.R., it is stated by the informant that twenty-five named accused persons including the petitioner herein as also 20-25 unknown persons came variously armed. It is further stated that Pinki Devi and Indu Kumari ordered that both of them should be killed. Sunil Rawat, Vijay Rawat, Mahesh Yadav and Prakash Yadav started to assault Ibran. Other accused persons also assaulted. Subsequently the dead body of Ibran was found.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.17431 of 2021(2) dt.27-08-2021 2/2 that the allegations as levelled in the F.I.R. are false and concocted. The allegations against the petitioner are general and omnibus in nature. He is not named among the accused persons who assaulted Ibran. The petitioner is in custody since 11.8.2020 and investigation in the case has concluded. It is submitted that his case stands on a similar footing to that of Subhash Rawat who has been enlarged on bail vide order dated 15.3.2021 passed in Cr.Misc. no.2451 of 2021. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner having remained in custody for over 1 year, this Court directs the petitioner to be enlarged on bail in connection with Jamui P.S. Case no.401 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui.
