JUSTICE PURNENDU SINGH ORAL ORDER 15-03-2023 Heard Mr. Shivendra Prasad, learned counsel appearing on behalf of the petitioner; Mr. Jharkhandi Upadhyay, learned counsel appearing on behalf of the informant and Mr. Ajit Kumar, learned APP appearing on behalf of the State.
2. Petitioner seeks bail in connection with Rampur Chauram P.S. Case No. 31 of 2020 registered under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.
3. Petitioner had earlier moved before this court for grant of regular bail by filing Cr. Misc. No. 27291 of 2021 which was rejected by this Court on 05.04.2022 with liberty to the petitioner to renew his prayer for bail after nine months if no substantial progress takes place in trial.
4. A report was called for from the court below with respect to the stage of the trial vide order dated 15.02.2023 and
Patna High Court CR. MISC. No.8092 of 2023(3) dt.15-03-2023 2/2 in compliance of the same, the Additional District and Sessions Judge-II, Jehanabad vide Letter No. 95 dated 21.02.2023 has informed that most of the prosecution witnesses have been examined and for production of the rest of the prosecution witnesses, bailable warrant has been issued against them.
5. Considering the fact that the trial has progressed considerably, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the bail application stands rejected.
6. The trial court is directed to conclude the trial expeditiously and the Superintendent of Police, Jehanabad is directed to produce all the remaining prosecution witnesses on the date fixed by the trial court without fail. (Purnendu Singh, J) Mantreshwar Aditya/- U T
