JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 The petitioner apprehends his arrest in connection with Bihta P.S.Case No. 1102 of 2018 registered under Sections 302/34 of the Indian penal Code and 27 of the Arms Act. Allegation against the petitioner is that he caught hold the deceased along with others and one Biteshwar Verma fired on him.

Submission of learned counsel for the petitioner is that petitioner is not the assailant and he has falsely been implicated in this case.

Heard learned APP also.

Having heard both sides and in view of allegation of active involvement of the petitioner, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy

Patna High Court CR. MISC. No.4841 of 2019(3) dt.12-03-2019 2/2 of this order and make prayer for regular bail, which shall be considered on its own merit without being prejudiced by this order.
