2. In the present case, the petitioner seeks bail in connection with Barari P.S. Case No. 278 of 2025, registered for the alleged offence under Sections 103(1), 3(5) of BNS, 2023.

3. As per prosecution case, the informant found his sister hanging from one of the rooms of his house. When she was taken to hospital, she was declared dead. Further allegation is that the sister of the informant was in love with co-accused Golu Singh and petitioner and other co-accused persons entered into the house of the informant and hanged the sister of the informant to death.

4. The learned counsel for the petitioner submits that

From the FIR, it is apparent that the room where dead body was found was locked from inside. So it is case of suicide, but the petitioner has been made accused with completely false allegation for obvious reasons. There is no eye witness to the whole occurrence. The police during investigation also found that the deceased was not hanged by the co-accused or this petitioner or any other person and it appears it was the informant and his family members, who killed her due to her love affair. The learned counsel further submits that the petitioner is in custody since 31.08.2025 and charge sheet has been submitted. The petitioner is having clean antecedent.

5. Learned APP vehemently opposes the submission made on behalf the petitioner.

Having regard to the facts and circumstances and submission made on behalf of the parties and considering the doubtful nature of allegation against the petitioner and also lack of material to show the complicity of the petitioner in the alleged occurrence and further considering the submission of charge sheet, period of custody of the petitioner and his clean antecedent, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two

No.5978 of 2026(2) dt.04-02-2026 3/3 sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Katihar/court concerned, in connection with Barari P.S. Case No. 278 of 2025, subject to the conditions mentioned in Section 480 (3) of BNSS and also the following conditions :

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
