The petitioners seek anticipatory bail in connection with Bagen Gola P.S.Case No. 50 of 2018, registered for offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Allegation as per F.I.R. against the petitioners, who happens to be the mother-in-law and brother-in-law of the deceased, is of killing the daughter of the informant and thrown into the water.

Submission of the learned counsel for the petitioners is that he has falsely been implicated in this case and they were living separately from the husband of the deceased and the petitioners have no criminal antecedent.

At the very outset learned A.P.P. pointed out that the

Having heard both sides and in view of the facts and circumstances as discussed above, the case of the petitioners is concerned, I am not inclined to grant bail to the petitioners, accordingly, prayer of anticipatory bail is rejected with a direction to the petitioners that if the petitioners surrender before the court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court. This application is accordingly disposed of.
