JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was twice rejected by this court and direction was given to the trial court to expedite the trial of the petitioner but the impugned order goes to show that up till now, only three prosecution witnesses could be examined. The petitioner is in jail custody since 11.02.2013 and having similar allegation, co-accused Suresh Yadav and some others have already been granted privilege of bail. The petitioner does not have any criminal antecedent, which is evident from perusal of para-3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.20491 of 2016 (2) dt.10-08-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Barh in connection with Sessions Trial No. 358 of 2014, arising out of Bakhtiyarpur P.S. Case No. 316 of 2012.
