JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he along with one other opened fire on the informant from his behind. The injury report of the informant reveals that he sustained two injuries, one is said to be multiple blackish spot over right scapula area and second is said to be abrasion on right forearm, probably said to be caused by firearm for which petitioner is in jail custody since 20.09.2014.

No doubt, petitioner is said to be caught just after the alleged occurrence but taking note of this fact that except the present case as well as one case under the Arms Act, there is no
