JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-04-2019 This is an application for grant of anticipatory bail in connection with Kako P.S. Case No. 170 of 2018, disclosing offences under Sections 306/34 of the Indian Penal Code. Allegation as per F.I.R. is that the informant has committed suicide due to mental torture meted out to him by his elder sister-in-law and elder brother-in-law. Submission of learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and materials collected during the course of investigation shows that there was strange relationship between the informant and his wife and only on suspicion, she has falsely been implicated in this case.

Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Jehanabad, in connection with Kako P.S. Case No. 170 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
