The petitioner is in custody since 02.12.2019 in connection with Special Case No. 10783 of 2019 arising out of Alamganj P.S. Case No. 904 ofr 2019 for the offence registered under Sections 30 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the alleged recovery was seized from a white colour vehicle which does not belong to the petitioner. It is further submitted that since nothing has been recovered from the possession of the petitioner and he is having a clean antecedent, the petitioner may be extended the privilege of bail.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.3819 of 2020(2) dt.21-01-2020 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Special Case No. 10783 of 2019 arising out of Alamganj P.S. Case No. 904 of 2019.
