At the outset, the learned counsel for the respondents has referred to the counter affidavit filed in the present case, more particularly paragraph no. 6 thereof, to submit that it has been stated therein that the encroachers have already vacated the encroached premises after the Circle Officer, Kusheshwar Asthan, Darbhanga had issued notice to them to remove the encroachment.

In view of the aforesaid, the learned counsel for the petitioner does not seek to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the respondent- authorities, in case the encroachment has re-surfaces. Liberty so sought, is granted.

The writ petition stands disposed off.
