The petitioner seeks bail in Ahiyapur P.S. Case No. 500 of 2018, instituted for the offence under Section(s) 379 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. No Test Identification Parade has been held. There is no recovery from his possession. He has been arrested by the Police in Ahiyapur P.S. Case No. 879 of 2018 and, thereafter, he has been remanded in the instant case.

Petitioner is in custody since 14.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.4866 of 2019(2) dt.05-02-2019 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S.
