The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 447, 341, 323, 324, 325, 307, 504 and 506/34 of the Indian Penal Code. The petitioner is in custody since 11.02.2013. It is alleged that on the order of Deveshwar Lal Deo, petitionter assaulted with Dabiya causing injury to the brother of the informant.

It is submitted by learned counsel for the petitioner that the injury was found simple. The earlier bail application of the petitioner was rejected only because the case was registered in 2003 and the petitioner was surrendered on

Patna High Court Cr.Misc. No.33322 of 2014 (03) dt.19-02-2015 2/2 11.02.2013.

Considering the nature of accusation, period under custody, the report of learned trial court at Flag 'A' which reflects that the trial is likely to be concluded within one year and a statement has been made in para 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional Sessions Judge, IV, Araria in connection with Sessions Trial No. 770 of 2013 arising out of Forbesganj P.S. Case No. 118 of 2003. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
