JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-07-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 467, 468, 399, 402, 471, 472, 420 and 489 (K) (Kha) (g) of the I.P.C and sections 25 (1-b) a, 26 and 35 of the Arms Act.

Allegedly, on the basis of the parallel listening of the mobile of co-accused Rohit Kumar Singh it transpires that to commit robbery plan was made and then the raid was conducted at the house of co-accused Yogendra Yadav from where five persons were caught including the petitioner and from possession of the

Patna High Court Cr.Misc. No.20607 of 2016 (3) dt.01-07-2016 2/3 petitioner two mobiles were recovered. From the house of Yogendra Yadav one country made pistol, cartridge, fake currency, colour printing machine etc. were recovered. Submission is of false implication and that the petitioner has been made victim of the circumstances, nothing was recovered from conscious possession of the petitioner, he has got no criminal antecedent and without any fault he is suffering in custody since 01.01.2016, other co-accused, namely, Rahul Sharma @ Payta, Rohit Kumar Singh and Md. Manouar @ Mansoor have already been allowed bail by the different Benches of this Court and as such the petitioner also deserves sympathetic consideration.

The learned A.P.P. fairly submits that other coaccused have been allowed bail. In the facts and circumstances as stated above, the petitioner is also directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Saran at Chapra in Chapra Mufassil P.S. Case No. 345 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain

Patna High Court Cr.Misc. No.20607 of 2016 (3) dt.01-07-2016 3/3 present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
