JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-04-2019 This application, for grant of anticipatory bail, arises out of Barauli P.S. Case No. 224 of 2017, disclosing offences under Sections 304(B), 201 and 120(B) of the Indian Penal Code.

Petitioner happens to be husband of the deceased and allegation against him is of causing death of the deceased for non fulfillment of demand of dowry of Rs. One lakh. Submission of learned counsel for the petitioner is that materials collected in course of investigation shows that the deceased was suffering from epilepsy and she was taken to hospital for treatment but could not be saved and maternal grandfather of the deceased was present at the time of cremation of dead body of the deceased.

Patna High Court CR. MISC. No.2179 of 2019(4) dt.16-04-2019 2/2 opposed the prayer for bail and submitted that without informing the informant, petitioner and others cremated the dead body of the deceased in a hurry manner.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additioal Chief Judicial Magistrate -XIV, Gopalganj, in connection with Barauli P.S. Case No. 224 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
