JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 23-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Jaipur P.S. Case No. 64 of 2021, registered for the offences punishable under Sections 420, 409, 467, 468, 471 and 120B of the Indian Penal Code.

As per allegation, there was huge misappropriation of the money in relation to the thirteen MNREGA schemes detailed in the FIR. In most of the schemes, the amount was withdrawn on the basis of fake measurement and in four schemes the money was withdrawn and the work has not even been started.

Learned counsel for the petitioner has submitted that he

Most of the work have been completed before joining of the present petitioner and he is co-signatory of the approval to the payment in relation to the schemes. The learned counsel has also submitted that as soon as the matter came to his knowledge he initiated the process of recovery of the money and till now Rs. 27,98,550/- have been recovered. He has submitted that he is taking his best efforts to recover the rest amount.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Banka in connection with Jaipur P.S. Case No. 64 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) niku/SonaliU T
