The petitioner seeks bail in a case under Section 379 of the Indian Penal Code and under section 136 of Electricity Act. The petitioner is not named in the FIR. The coil of 25 K.V. A. transformer was stolen causing loss of Rs. 35,000/- to the electricity department. One Neyaz Dewan was apprehended by the police and in his confessional statement name of the petitioner surfaced in the case. From the house of the petitioner 10 kg. copper wire was recovered which is said to be stolen property of Chautarwa P. S. case No. 209 of 2014. Nothing has been recovered from the possession of the petitioner in connection with the present case. Neyaz Dewan has already been enlarged on bail

Patna High Court Cr.Misc. No.33298 of 2015 (2) dt.19-08-2015 2/2 vide order passed in Cr. Misc. 16152 of 2015. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bagaha, West Champaran in Bagaha P.S. Case No. 330/2014.
