The petitioner seeks pre-arrest bail in connection with Deo P.S. Case No. 19 of 2016 registered under Sections 420, 467 & 468 read with 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the FIR against the petitioner has been instituted on account of ignorance and misunderstanding. It is submitted that it was the bank personnel who had asked the informant to re-give her thumb impression and not the petitioner and in that view of the matter, the petitioner cannot be held responsible for any act of omission or commission as alleged in the FIR. Lastly,
Patna High Court Cr.Misc. No.20742 of 2016 (3) dt.23-05-2016 2 / 2 it has been contended that later on the informant has amicably settled the matter with the petitioner outside the court. Learned counsel for the State has opposed the application for grant of pre-arrest bail.
Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Deo P.S. Case No. 19 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C.
