The petitioner seeks bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The informant named seven persons including the petitioner and alleged that the petitioner assaulted the informant Suryanarayan Mahto with Pharsa on his head. The petitioner has not assaulted any other persons. The informant got two injuries one is incised wound on mid of scalp and another is abrasion on the scalp. The doctor examined Suryanarayan Mahto in Primary Health Centre and referred the patient Suryanarayan Mahto to Darbhanga Medical College Hospital keeping the opinion reserved with regard to nature of injury. Patna High Court Cr.Misc. No.32702 of 2015 (3) dt.25-08-2015 2/2 perusing the CT scan did not find any abnormality and directed to get opinion with regard to nature of injury from the place where Suryanarayan Mahto was firstly examined.

The learned counsel for the informant vehemently opposed the prayer for bail and submitted that the petitioner has got criminal antecedent.

It appears that the injury appears to be simple in nature, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in Bahera P.S. Case No. 245 of 2015.
