2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Belhar P.S. Case no. 11 of 2024 instituted for the offence under Sections 341, 323, 307, 354, 379, 504 and 506/34 of the Indian Penal Code.

3. The case of the prosecution is that the petitioner along with others being armed with 'lathi, 'khanti' and 'iron rod' entered into the house of the informant and caught hold of her hand. It is further alleged that she was abused and assaulted. The specific allegation is against Ganesh Tanti who knocked down the mother-in-law of the informant. When she raised alarm, her husband and father-in-law arrived. It is further alleged that accused persons assaulted them with 'iron rod'.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.5003 of 2026(2) dt.09-02-2026 2/2 that petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that from perusal of the FIR, it is clear that the petitioner is only a member of the MOB and no overt act has been alleged against him. There is general and omnibus allegation against him. It is further submitted that the petitioner has no criminal antecedent.

5. Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Belhar P.S. Case no. 11 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, subject to the conditions as laid down under section 438(2) of the Cr.P.C/ Section 482 (2) of the BNSS.
