Mr. Mritunjay Kumar Nirala ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 4.
05-04-2019 Heard Sri Shiv Prasad Gupta, learned counsel for the petitioner and Sri Mritunjay Kumar Nirala, learned Addl. Public Prosecutor.
The sole petitioner, who is solely made accused in the F.I.R. with specific accusation, has prayed for grant of bail in the event of his arrest or surrender in Sahar P.S. Case No. 218 of 2018 registered for offence under Sections 341, 323, 324, 308, 504 of the Indian Penal Code.
Learned counsel for the petitioner tried to persuade the Court that save and except Section 308 of the Indian Penal Code, all the sections are bailable.
However, considering the fact that there is specific accusation against the petitioner, there is no reason to entertain the prayer for anticipatory bail.
Patna High Court CR. MISC. No.8004 of 2019(4) dt.05-04-2019 2/2 The anticipatory bail petition stands dismissed. (Rakesh Kumar, J.) anay U T
