JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 465, 467, 468, 471 and 406 of the Indian Penal Code.

The petitioner is said to have taken vehicle of the informant on hire but subsequently having prepared forged documents, transferred the said vehicle to one Kailash Yadav, from whose possession the said vehicle was recovered, after institution of the present case.

Contention on behalf of the petitioner is that as a matter of fact the petitioner had taken loan from the aforesaid Kailash Yadav but could not succeed to return the loan amount

Patna High Court Cr.Misc. No.20483 of 2016 (2) dt.18-05-2016 within time as a result the aforesaid Kailash Yadav forcibly took the vehicle from the house of the petitioner and after that the informant lodged the present case. Moreover, the petitioner is in jail custody since 02.02.2016 and the investigation against him appears to have already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar P.S. Case No. 39 of 2016.
