The petitioners apprehend their arrest in connection with Korha P.S. Case No.115/2021, registered for the offence punishable u/s 363/366(A) of the IPC.
As per the prosecution case, the F.I.R. named accused persons including the petitioners are said to be involved in kidnapping of minor daughter of the informant. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged, has ever taken place. The allegation leveled against the petitioners is not
Patna High Court CR. MISC. No.9960 of 2023(2) dt.20-04-2023 2/2 specific rather general and omnibus in nature. The specific allegation of kidnapping the daughter of the informant is against co-accused Mithilesh Kumar @ Kanihiya. Petitioners have no criminal antecedent.
Learned APP for the State opposed the prayer for bail. Considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioners on bail. The prayer for grant of anticipatory bail on behalf of the petitioners named above is hereby rejected. However, petitioners are at liberty to surrender before the learned Court below within a period of six weeks from today and the learned Court below would pass order, preferably on the same day, in accordance with law.
With the aforesaid observation, this application stands dismissed.
