The petitioner seeks regular bail in connection with N.D.P.S. Case No. 126/2020, arising out of Sahebganj P.S. Case No. 603/2020, instituted for the offence under Sections 399, 402 of the Indian Penal Code read with under sections 25(1-b) a/26/35 of the Arms Act and under sections 8/20/22 of the N.D.P.S. Act.

Learned counsel for the petitioner submitted that there is no recovery against the petitioner. Learned counsel further submits that neither any arms or ammunition nor any narcotic substance has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 30.11.2020 for no fault on his part. It is also submitted that charge-sheet has

Patna High Court CR. MISC. No.5561 of 2022(2) dt.08-06-2022 2/2 already been submitted. It is further submitted that two coaccused persons namely Ranjeet Paswan and Raju Kumar Paswan had already been granted bail vide Annexure-2 and Annexure-2A series.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail application of the petitioner. Considering the fact that the petitioner is in custody since 30.11.2020, charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-V, Muzaffarpur in connection with N.D.P.S. Case No. 126/2020, arising out of Sahebganj P.S. Case No. 603/2020.
