The petitioner, who had applied for being appointed on Class-IV post pursuant to an advertisement issued by the respondent Bank, was successful but no order of appointment was issued to him. It was only later in the day that the petitioner learnt that in derogation of the conditions in the advertisement which required that the merit list would be prepared on the basis of marks obtained by a candidate in Intermediate examination, the merit list appears to have

Patna High Court CWJC No.1655 of 2019(2) dt.31-01-2019 2/3 been prepared by taking into account the marks of matriculation as well as of the Intermediate examination. Learned counsel for the petitioner has submitted that it is on account of such faulty preparation of the merit list that Respondent No. 7 has wrongly been appointed and the petitioner has lost out in the race.

The aforesaid fact was found to be correct before the Chief Information Commissioner and it further appears that since all the candidates had given their matriculation certificates for the purposes of disclosing their ages, the marks in the matriculation also was added for preparation of the merit list. This was clearly against the direction indicated in the advertisement against which the petitioner had applied.

The representation of the petitioner before various authorities of the Bank have yielded no result. Under the circumstances, the petitioner is directed to represent before the Circle Head of Punjab National Bank at Muzaffarpur within a period of two weeks from today. On such representation, along with a copy of this order, the

Patna High Court CWJC No.1655 of 2019(2) dt.31-01-2019 3/3 Circle Head, shall after verifying the fact and after obtaining necessary sanction from the Head Office, shall pass necessary orders in accordance with law and dispose off such representation. In case it is found that the claim of the petitioner is tenable, necessary orders shall be passed. The whole process be completed within a period of eight weeks. With the aforesaid observation / direction, this writ petition stands disposed off.
