2. The petitioner seeks bail in connection with Dandkora P.S. Case No. 57/2025 registered for the offences punishable under Sections 64(2), 332(b), 127, 352, 351(2) and 3(5) of B.N.S. and Sections 4/6 of POCSO Act.
3. As per the prosecution case, petitioner is accused of trying to commit rape with a 12-year old girl after molesting her.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. Learned counsel further submits that FIR has been lodged after a delay of 17 days and the statement of the victim girl has not been
Patna High Court CR. MISC. No.5905 of 2026(3) dt.31-03-2026 2/2 recorded in accordance with Section 35 (1) of POCSO Act. Petitioner has no criminal antecedent and he is in custody since 01.06.2025. The petitioner undertakes to co-operate in the case/ trial.
5. Learned APP for the State as well as learned counsel for the informant have jointly opposed the prayer for regular bail of the petitioner.
6. Considering the gravity of the offence as well as the fact that the victim in her statement recorded under Section 183 B.N.S.S has supported the prosecution, this Court is not inclined to grant bail to the petitioner.
