JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-06-2016 Heard the learned counsel for the petitioners and the learned A.P.P. representing the State.

The petitioners want to renew their prayer for bail which was earlier rejected by order dated 14.10.2015 passed in Criminal Miscellaneous No. 27276 of 2015 on the ground that the charge has already been framed on 01.02.2016 which is evident from the impugned order itself and in near future, the trial is not likely to be concluded. There is also no chance of tampering with prosecution evidence.

The learned APP fairly submits that in view of observation, lenient view can be taken.

In the facts and circumstances stated above, now the

Patna High Court Cr.Misc. No.20977 of 2016 (3) dt.22-06-2016 2/2 petitioners are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Budha Colony P.S. Case No. 347 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
