The petitioners seek bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379, 504/34 of the Indian Penal Code. It is submitted that the allegation against the petitioner Pawan Thakur is to have assaulted the informant with Lathi. There is no specific allegation of assault against the petitioners Sanjay Thakur and Agnish Thakur. There is case and counter case between both the parties for the same occurrence. The allegation against co-accused Awadhesh Thakur is to have inflicted farsa blow on the head of the informant causing grievous injury and he

Patna High Court Cr.Misc. No.28463 of 2015 (2) dt.10-08-2015 2/2 has been granted bail vide Cr. Misc. No.40793 of 2014 (Annexure-4). The petitioners have no criminal antecedents. Considering the facts and circumstances of the case, let the above-named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in Ramgarhwa P.S. Case No.65 of 2014 with the following conditions : 1.

One of the bailors will be the close relative of the petitioners.

The petitioners will not indulge in similar or in any other offence.

3.

The petitioners will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
